Me and my child moved here thru K1 Visa and K2 Visa respectively. K1 visa allowed me to enter US to marry my US citizen fiance and k2 visa for my unmarried child below 21 years old. Me and my fiance are now married but my child is lulling using my maiden name. Does anyone know what action shall we take so that my son can eventually use my husband’s name? We are planning to send him to preschool and we wouldn’t want him to get curious on how come that he is using a different surname/last name. I am wondering if my husband needs to adopt him……can somebody help us on this? Thanks.

Your son would need to have his name changed legally. In your situation, your husband would need to adopt your son in order to have the same last name as you.Also, now that you have married your husband, you will likely be applying for your Permanent Residency card shortly. You will also need to apply for permanent residency for your son. USCIS will not change your son’s name from your maiden name unless you can present legal documentation, such as adoption papers or a court order, changing your son’s last name to your husband’s.Hope this helps!
