Question by PhotoFreak: Important Question ?

So. There is the deal. My dad met with one women 4 years ago. In 2005( I was 15 then) they decided that my dad will move to the US and I will move with him. So we both got K1 and K2 Visas (some fiance and fiance child or whatever) visa. We came in here and then made Green card with the K1-K2 visa. Now 3 years later in 2008(I’m 18) I think that they will divorce presently. So now I’m worried that I haven’t got citizenship’s yet and also my dad isn’t (should get ours in 2009 spring) will they send me or him out of the country? Because he(and me) came in here with Fiance Visa which gave us the Green card and now when they divorce do they cancel the Green card? It doesn’t actually sounds logical because when they cancel his then they shouldn’t cancel mine because I’m 18 and I tin live alone and be independent and work and it isn’t my fault that they screw something up. Huh that is confusing. Well does 2 years Green card will be counted as a Permanent residence card? I got it in 2006 Autumn. It is the 1st green card. I will get the 10 years Green card in this spring/winter.

Have you applied for permanent residency? Once you become a permanent resident–whether by K1, J1, or even an I-120, then you do not have to worry about ever defaulting and having to leave the country. Chances are, if you are applying for citizenship, you have already applied for a change of status from K1 to permanent resident. So, no worries. You don’t ever have to apply for citizenship if you do not want to. Once you are a permanent resident, you do not have to go further. However, if you don’t go further, you will not be able to vote, hold a federal job, etc.
