Question by : how do you cancel a K1 Visa and K2 Visa after it is issued?
How can i cancel my fiancee and her childs visa after it has been issued? they have not entered the usa yet.

You can’t. Once it is issued, it is theirs. Even they enter to US, don’t get married and don’t file AOS for them is all you can do.

  1. well, you could always contact the embassy, but chances are they’ve already left for the US. In which case, as noted, don’t marry her, and don’t file the paperwork. after 90 days, she’ll be out of status and illegal. even if she marries a different American, she’ll have to leave. she can’t get any other status if you don’t marry her.

  2. If your fiance has already received the K-1 visa in her passport, it’s difficult. You should make a written request to the Embassy asking to withdraw the petition. You may wish to notarize such a statement so they can be assured that you personally are asking the petition to be withdrawn. They might try to call your fiance back into the embassy to cancel the visas, but I wouldn’t count on that happening.

    You should also inform the CIS office that approved the K-1 petition that you would like to withdraw your petition.

  3. You could try contacting ICE and telling them the visa is issued but the holder does not intend to use it for the purpose intended ..they can put a note on the screen for the POE

  4. Did you have to file a waiver? Did you already have your interview? You need to remove conditions within 90 days after entering the US, so if she doesn’t remove conditions, then she will be on a deportation list.
