My mom brought me her on her K2 fiance/spouse visa and now 12 years later I’m illegal with no way out?
Question by D N: My mom brought me her on her k2 fiance/spouse visa and now 12 years later I’m illegal with no way out?
My mom brought me here with her when I was 5 years old with a K1 Visa or the fiance or spouse visa and I received a K2 Visa. They never got married and I ended up seemly illegal. I have lived here my entire life and have no social security number and seems like I’m trapped. I’m almost 18 now and have no idea what to do. Is there a way for me to become legal? Do I marry someone an us citizen or what do I do?

You didn’t receive a K-2 at five years old.
There’s no such thing as a K-1 fiance/spouse visa. It’s either K-1 spouse visa or K-2 fiance visa. If, in fact what you say was true, you would have been included in your mothers visa.
You’re not trapped, your mother should take you, and herself, back to your home country and re-enter legally.

your mom screwed ya brother– contact immigration and ask them what you should do
There is a way out,go back to your home country.
If you go back before you turn 18 1/2,you can apply to return legally without penalty and your illegal stay here will not be held against you. If you do not leave by that time, you are making the decision on your own,as an adult,to ignore our immigration laws.
Marriage will not help you,you would still have to leave the country to file for a visa.
Your mother should have left when she didn’t get married as was the purpose for her immigration here. Her decision is what has put you in this situation.
