Question by : Letter from parent for child’s K2 Visa?
My Fiancee is applying for a K1 Visa. Her daughter will be accompanying her with a K2 Visa. She needs a notarized letter from the father, to give the mother permission to leave the country with their daughter. The father abandoned the mother and daughter years ago, and she is unable to locate him. My Fiancee raised her child by herself since birth. What are her options?She’s from Philippines….The Father is on the birth certificate. But she is unable to locate him. Last time she heard that he is working abroad somewhere. She is trying to relocate to the US with a Fiancee visa to marry me.

  1. Does her daughter carries the father’s last name? did he sign her birth certificate? If not, she can take her anywhere without the father’s permission. She will need a notarized letter from a lawyer saying the child was born out of wedlock and that the father is unknown.

  2. Find a Family Law attorney practicing in the Philippines.

    He can help the mother to apply to the courts to remove the absentee parents rights.

    Once the court grants sole custody rights to the mother she can take the child out of the Philippines without the fathers permission.
