Just a follow up to my previous question with regards to the US visa process for the USA. Now before you furnish all the documents send off the relevant forms we want to make sure he’s done it all correct so we’re not held up in the processing system. Do we need to send his passport photos and a covering letter with the US Visa application? What other items do you think we should send with the application for the K1 Visa or the I-129a? We have all the copies of the phonebills and also a few pics from our holidays and also copies of my passport with date of entry stamps when I went to visit. Do we need anything else for the Us application?

I now already know all I need to know about a K1 Visa. Firstly I am British and he is an Americian so we are now considering about doing it when we are ready to. So now I am just worrying if I get a K1 Visa successfully do I now have to get married in the United States or can I get married in any other country within the 90 days/ if I return back to the United States in 90 days? I cannot find an answer anywere so it would be helpful to know – Thanks

Apparently you clearly don’t know all about the K1 Visa. It is a fiancee visa to let you into United States so that you can get married in the United States within 90 days or your arrival so that you apply for the green card. Therefore, you must get married and you must have US marriage certificate. Until you get green card, you cannot work or leave US. Except if you apply EAD and AP and has approved, then you can work or travel.

I have now had my K1 Visa approved which is now only valid for  6 months (3 months and then an additional 3 months once I am married). Once I have married my fiancee within that 3 month legal period, how do I then apply for the 2 year K1 Visa?

The Fiance Visa is also known as a US K1 Visa. Once married your spouse or wife needs to file a I-485 and I-765 to adjust her status. Now once approved this will get her a 2 year conditional green card.

I did something stupid recently when I got arrested for a marijuana charge in the US. How is this charge going to affect my fiancee from obtaining a K1 Visa to come to the US? Her interview will be in a few weeks time.

If you are the US petitioner for the visa  it will not affect her K1 Visa application. Now of course, if you wound up in jail with the charge that could become a major problem as you only have 90 days to get married once she arrives in the US. It  doesn’t however sound like that will be happening to you. However they aren’t really much concerned about you as they are much more concerned about your fiancee. If your fiancee had the charge then you would have much bigger problems.

We arrived here on a K1 Visa and K2 Visa and I got married within the 90-day period but failed to file the AOS flop away. I have the marriage certificate on hand & currently filling out the I-485 & I-130 along with Affidavit of Support so I can file this within the month. We are planning to take a vacation in 3 weeks and traveling to another state but not sure if they will let me & the kids on the shaven given my current status. Our passports only show the k -visas and I-94 that has already expired June 2007. I am really worried.

There’s no guarantee on this anymore. TSA has started to do more checking on the status of foreign travelers. Could be they won’t check at all, but if they question your status, you will be delayed while they’re corroboratory it. How yearn that will take will depend on whether they have immigration people at the airport, and how busy they are.

No, once she did not get married within the 90 days as allowed on the visa, she became out of status (Illegal). Out of status alien can NOT adjust status inside the United States.The longer that she is illegally in the United States, the longer the possible ban will be, and may make her inadmissible for up to 10 years. She needs to leave the US and then you can again apply for the K1.
