Can a K2 Visa holder marry a U.S. citizen and apply for Green Card?
Question by Bobbak: Can a K2 Visa holder marry an U.S. citizen and apply for Green Card?
If the K1 Visa (Parent) had divorced before the process of Green Card was complete, can the K2 Visa (Child) who just turned 19 marry an US citizen and file for green card on his/her own? I know that it’s impossible for the Parent to remarry and chaneg his/her status, but is it true for the K2 also?(This is an issue even lawyers aren’t sure about! Please help.)

Yes, absolutely. If the K2 gets married to an US citizen there should be no problem staying in the United States. I would think that all it should take is an I-485 to adjust status to IR-1.The K2, after getting married, cannot petition the K1. You must be an US citizen to petition a parent.

its possible, and lawyers dont know everything so dont ever assume they do, they are more interested in ur money.
so its goes like this and you have 2 choices.
you can get the green card based on your k2 status and apply for citizenship 5 years from now. or…
you can get married, have your new spouse start the process of filing for you again ( thats right, you will not be able to get citizenship or green card from the k2 is you let it expire and dont file based on your parent’s k1). so anyways, this involves the adjustment package and your new spouse would have to do that for you, then you could file for naturalization 3 years after you get your green card from that petition. make sense? i reccomend calling the national customer service center for that info.
