If you have a K1 Visa and would like to leave the US after arriving but before getting married then you first need to apply for advance parole.  If you dont have an advance parole in your passport the K1 Visa becomes null and void.

If you brought children with you on a K2 visa then they would also need to have advance parole to leave the country without the visa being viewed as abandoned.

The advance parole is meant for anyone who live sin the US on a temporary bases. These would include all the following people:

  • Anyone on a temporary visa in the US;
  • Those awaiting an adjustment of status;
  • Those under section 203 of the Nicaraguan Adjustment;
  • Anyone on an asylum status;
  • Any pending application with regards to status;
  • Pending legalization.
  • K1 Visa and K2 Visa holder

If you leave the Us on an advance parole it does no extend the K1 Visa and the 90 days limit is still applicable to the visa. If you arrived on 1st January then leave on the 30th January the 30 days is still applicable when you arrive back in the US. Be certain to speak to US Immigration before you leave the US to ensure that you would be allowed back in and what the time limits would be when you return.
